THE LEGISLATION EXPLAINED

Introduced in 2024, amendments to the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021 made it mandatory for ALL NSW home owners to install child window safety devices to high-risk windows in their property or risk personal liability.

Following recommendations from the Deputy State Coroner, the NSW Department of Planning has introduced reforms to window safety regulations. These reforms target older homes and non-strata apartment buildings, with the primary aim to stop children from falling from windows in NSW homes

Window safety requirements previously only applied to NSW residential buildings that were in strata scheme under the Strata Schemes Management Act and Strata Schemes Management Regulation 2016 (SSM Regulation). These requirements have now been extended to include residential buildings that are not within a strata scheme, such as individually owned buildings (Torrens title) or company titled buildings.

WHO IS REQUIRED TO INSTALL WINDOW SAFETY DEVICES?

It is now mandatory to install window safety devices on specified high risk windows of most residential dwellings. This applies to houses, townhouses, terraces, apartments and any other dwellings that are Torrens Titled or Company Titled.

Property owners are responsible for the cost of supply and installation of window safety devices. And while it is not mandatory to have devices professionally installed, the devices must meet legislative requirements and pass testing criteria.

Window safety compliance ongoing checks and maintenance

Ongoing Safety Compliance Checks

It is essential for Strata Managers and Owners’ Corporations to continue to meet their legal responsibilities through regular inspections, maintenance and testing of window safety devices.

Over time, window safety devices can fail to work effectively, resulting in your windows becoming non-compliant.

This can be a result of:

  • Device Misuse

  • Device Removal

  • General Damage

  • Lost Keys

ASQB recommends having window safety devices checked annually, at a minimum

What a Window Safety Compliance Check Involves

The inspection and assessment of every child window safety device throughout a residence, as well as the general condition of each affected window.

Each window safety device will be checked in accordance with legislative requirements. This includes a functionality assessment, force testing, and measurement evaluation.

If required, on the spot maintenance or replacement of non-compliant child window safety devices will be performed. This includes lock alterations/adjustments, key replacement (if possible), and device replacement, if necessary.

An updated compliance certificate will be issued for each residence visited. This will include photographic and location descriptive evidence of each child window safety device checked, and any replacements that are installed

How do I know if my current child window safety devices meet legislative requirements?

A window safety device that meets legal requirements must answer yes to the following questions:

WINDOW SAFETY DEVICE

1. Are the keys present?
2. Can the window be locked in the closed position?
3. Can the window be locked in a vent position less than 12.5cm?
4. When the lock is engaged, can it resist a force greater than 25kg?

GENERAL WINDOW CONDITION : The condition of both the frame and sash should also be considered when assessing the window safety device. If the window does not operate as intended, it should undergo a service to ensure occupants’ safety.

WINDOW SECURITY SCREEN (including bars & safety grills)

1. Are all gaps less than 12.5cm?
2. Can the screen resist an outward pressure of 25kg?

GENERAL WINDOW CONDITION : The condition of both the frame and sash should also be considered when assessing any screens or grills that are attached to them. If the window does not operate as intended, it should undergo a service to ensure occupants’ safety.
